STANDARD DISCLAIMER 

The manufacturer, Lodge Logs, sells its products with no express or implied Warranty of any type except as is stated in The Lodge Logs Limited Lifetime Warranty.

Purchaser shall assume sole responsibility for determining the adequacy of construction sites, and for all matters related to the erection and construction process.

 LIMITED LIFETIME WARRANTY 

Lodge Logs warrants the products manufactured by it to be free from defects in material and factory workmanship, in accordance with generally accepted industry standards, at the time of purchase.  Lodge Logs further warrants its log wall system to remain structurally sound and serviceable as a log wall system, when properly installed and maintained, for the lifetime of the original purchaser so long as the original purchaser resides in the log home as his primary or secondary residence.  The term “original purchaser” shall be defined to mean the person for whom the log package was originally constructed into a log home, and shall include the purchaser of any log home built by a contractor as a “Spec” home and log homes constructed for commercial uses or applications, but does not include subsequent purchasers, users, rental properties or tenants or other persons. This Limited Warranty does not extend to minor surface cracking, checking, warping, and discoloration and sap pockets, which, due to the inherent characteristics of wood, may occur from time to time, and is normal and acceptable.  This Limited Warranty is further subject to proper construction and maintenance of the product. 

Purchaser shall have the right and responsibility to inspect within ten (10) days after materials are unloaded off the carrier.  If Purchaser uses the materials or fails to inspect within this time, Purchaser will be deemed to have waived inspection and to have unequivocally accepted the materials.  Once Purchaser has inspected the materials or waives inspection, Purchaser shall not be able to revoke acceptance or later reject the materials. In the event Purchaser believes variances in manufacturing and grade are in excess of the allowable 5%, Purchaser and Lodge Logs agree to abide by the procedures for complaint and re-inspection as promulgated in the Log Home Grading Rules, November 1987, Timber Products Inspection, Inc., telephone (360) 449-3840.  A written complaint must be filed in a timely manner prior to materials being used.  Purchaser shall bear the expense of re-inspection unless below grade materials exceed 5%.  Lodge Log’s Limited Lifetime Warranty shall be deemed null and void and Purchaser shall be solely responsible for any alleged “defects” in log products or log wall systems and components, including variances of materials below grade, if the log products/log wall system and/or component parts thereof have not been completely assembled within six (6) months of the date of the completion of manufacture, or if improper assembly is utilized.  All log products, log wall systems and component parts thereof must be stored indoors or in a weather protected environment (i.e., protected from weather and moisture).  Lodge Logs does not warrant any log product, log wall system or component thereof against damage due to weather exposure, mold, wood rot, mildew, etc.

 If Lodge Logs, after inspection and verification, determines that the log products and/or the log wall system is below accepted manufacturing or grade allowances or that the product or log wall system had failed, as a result of defects in materials or factory workmanship, under the terms of this Limited Warranty within the life of the original Purchaser so long as the building is still occupied by the original Purchaser, Lodge Logs shall, at its option, repair or replace the affected part or product, including all labor, materials and handling and shipping charges during the first two (2) years following purchase; thereafter Lodge Logs will replace the affected part or product, materials only after 2 years from date of purchase; any and all costs of installation and all shipping and handling  charges shall be paid by the Purchaser making claim under this Limited  Warranty.

 Satisfactory performance of Lodge Logs products, under the terms of this Limited Warranty, is dependent upon proper installation and maintenance in strict accordance with published guidelines, which guidelines are attached hereto and by this reference incorporated herein as if set forth in full.  Thru-bolts must be periodically tightened until all settling has ceased and exterior wood products must be finished and maintained with a quality penetrating wood preservative that repels water, inhibits growth of mold, mildew and fungus, and deters insects.  Proper attention to damage resulting from impact or abuse is required owner maintenance.  Failure to perform normal owner maintenance or to follow installation instructions shall result in this Limited Warranty becoming null and void.

 This Limited Warranty extends to the original purchaser of Lodge Logs Products only, and shall not apply to any subsequent purchaser, user or other person or entity.  Lodge Logs makes no Warranty whatsoever with respect to products not of its own manufacture.  Claims under this Limited Warranty must be made in writing, within the period of the Limited Warranty and prior to the beginning of any repair work.  The liability of Lodge Logs is limited to repair or replacement of any defective parts or products manufactured by Lodge Logs.  Lodge Logs will not be liable for any other expense, loss or damage, including but not limited to incidental or consequential damage, arising in connection with the sale, use or inability to use Lodge Logs Products for any purpose.  This Limited Warranty is exclusive and in lieu of any and all other warranties, express or implied, including without limitation, warranties of merchantability and fitness for use.  Lodge Logs does not assume, nor authorize any other person, expressly or impliedly, to assume on behalf of Lodge Logs, any other liability in connection with the sale of the precision milled and crafted logs manufactured by Lodge Logs.  Any implied warranties required by law are hereby limited to the period of one (1) year from the date of sale.  Some states do not allow limitations on how long a Limited Warranty may last or the exclusion or limitation of incidental or consequential damages, so the above exclusions or limitation may not apply to certain purchasers.  This Limited Warranty gives purchasers specific legal rights, and purchasers may have other rights, which vary from state to state.  This Limited Warranty shall be governed and construed according to laws of the state of Idaho.  Jurisdiction and Venue for any action relating to this Limited Warranty shall be Ada County, Idaho.
